Obama's Highhanded Immigration Hypocrisy David Limbaugh | Feb 27, 2015

Honestly, are any of my Democratic friends even slightly bothered by President Obama's habitual and brazen lawlessness and what that could mean for our liberties?

Does it bother them that he implemented two new administration programs to halt deportations and allow work permits for up to 5 million immigrants living illegally in the United States after clearly admitting he didn't have the constitutional authority to do so?

Does it bother them that after having done so, despite his insincere promise, he has been openly defiant about the decision U.S. District Judge Andrew Hanen made in favor of the states trying to block Obama's unlawful act? Obama said: "This is just one federal judge. We have appealed it very aggressively. ... I'm using all of the legal power vested in me in order to solve this problem." Me, me, me.

Does it bother them that his administration has begun to refer to these immigrants as "Americans-in-waiting" -- as if his iron will controls, irrespective of the Constitution, the law and the prerogative of the coequal legislative branch?

Does it bother them that, like a Third World despot tyrannizing his subjects, he said in a town hall forum in Miami that there will be consequences for any federal agents who ignore his new policies? Obama said, "If somebody's working for (U.S. Immigration and Customs Enforcement) ... and they don't follow the policy, there are going to be consequences to it."

Are such threatened consequences, by the way, really the business of a chief executive, even if he is acting lawfully? Isn't his indignation a bit tough to take, given his own propensity not to follow the law? Does anyone ever make him face consequences for not just ignoring but violating laws?

As others have pointed out, Obama's position on this issue, despite being legally wrong, is inconsistent. His entire rationale is that these actions are within his executive power because it is a matter of prioritizing immigration enforcement efforts with limited congressional funding. Yet he will have zero tolerance for immigration officials who attempt to exercise their discretion in not enforcing his "orders."

Also, Obama's characterization of his executive action as a matter of prosecutorial discretion is disingenuous. Judge Hanen clearly held that Obama's program of Deferred Action for Parents of Americans and Lawful Permanent Residents is "actually affirmative action rather than inaction" because the program grants "legal presence to individuals Congress has deemed deportable or removable, as well as the ability to obtain Social Security numbers, work authorization permits, and the ability to travel."

It is absurd for Obama to claim that his action is within his prosecutorial discretion when it not only involves a decision not to enforce a law or ruling but also grants new rights, as Hanen noted, and is in contravention of existing laws. As Texas Attorney General Ken Paxton has argued, "the president, on his own, has issued a separate action in opposition to current law." This action, says Paxton, will cost his state hundreds of millions of dollars for education, health care and public safety.

Do you understand the argument? Obama isn't just turning his back on deportment. He is granting substantive rights to immigrants that are not his to grant, foisting the cost of those new rights onto the states without their consent -- and doing so in violation of existing laws.

The administration's duplicity is readily apparent when you listen to the weasel words of Sarah Saldana, director of ICE, in the emergency motion filed by the Obama administration to stay Hanen's ruling. Saldana said, "Preventing the deferred action policies from going into effect interferes with the Federal Government's comprehensive strategy for enforcing our immigration laws."

Do those words, on their face, make sense? How does preventing Obama's newly granted affirmative privileges to these immigrants from taking effect interfere with the government's strategy for enforcing its immigration laws? Isn't it more accurate and honest to say that it interferes with Obama's attempt not to enforce those laws and to grant affirmative rights to immigrants that Obama decidedly has no authority to grant as president?

An action does not become something it is not just because government officials describe or denominate it as such. Otherwise, the Affordable Care Act would not be raising health care costs for millions of American families, and Obama's scheme to commandeer the Internet wouldn't be called "net neutrality." Obama's illegal immigration actions are not within his executive authority merely because he depicts them as within his prosecutorial discretion.

Obama's arrogance may cost him this time, as he has gone way too far, even for him, by flagrantly violating the separation of powers and exceeding his executive authority in granting new rights to immigrants who are here illegally, providing no notice to the states of his action to allow for public feedback and saddling the states with enormous financial burdens.

What if the current massive spying on Americans began with an innocent secret executive order signed by President Reagan in 1986? What if Reagan contemplated that he was only authorizing American spies to spy on foreign spies unlawfully present in the U.S.?

What if Reagan knew and respected the history of the Fourth Amendment? What if the essence of that history is the colonial revulsion at the British use of general warrants? What if general warrants were issued by a secret court in London and authorized British agents in America to search wherever they wished and to seize whatever they found? What if the revulsion at this British government practice was so overwhelming that it led to the Revolutionary War against the king?

What if the whole purpose of the Fourth Amendment was to outlaw general warrants? What if the Fourth Amendment specifically guarantees the right to privacy to all in America in their persons, houses, papers and effects?

What if, in order to emphasize its condemnation of general warrants, the Fourth Amendment requires the government to obtain a warrant from a judge before invading the persons, houses, papers or effects of anyone and lays down the preconditions for the issuance of such warrants? What if those preconditions are individualized suspicion and articulated evidence of crime -- called probable cause -- about the specific person whose privacy the government seeks to invade?

What if these principles of constitutional fidelity, privacy and probable cause and the unlawfulness of general warrants have been regarded universally and publicly as quintessentially American values, values that set this nation apart from all others?

What if the administration of President George W. Bush was so embarrassed that 9/11 happened on its watch that it fought a useless public war in Iraq -- which had nothing to do with 9/11 -- and a pernicious private war against American values by unleashing American spies on innocent Americans as to whom there was no individualized probable cause so that it could create the impression it was doing something to keep America safe from another 9/11-like attack?

What if the Bush folks took Reagan's idea of spying on foreign spies and twisted it so that they could spy on not just foreign spies, but also on foreign persons? What if they took that and leapt to spying on Americans who communicated with foreign persons?

What if they then concluded that it was easier to spy on all Americans rather than just those who communicated with foreign persons? What if they claimed in secret that all this was authorized by Reagan's executive order and two federal statutes, their unique interpretations of which they refused to discuss in public? What if the Reagan order and the statutes authorized no such thing?

What if The New York Times caught the Bush administration in its massive violation of the Fourth Amendment, whereby it was spying on all Americans all the time without any warrants? What if the Times sat on that knowledge during, throughout and beyond the presidential election campaign of 2004? What if, when the Times revealed all this, the Bush administration agreed to stop spying? What if it didn't stop?

What if President Obama came up with a scheme to make the spying appear legal? What if that scheme involved using secret judges in secret courts to issue general warrants? What if the Obama administration swore those judges to secrecy? What if it swore to secrecy all in the government who are involved in undermining basic American values? What if it forgot that everyone in government also swears an oath to uphold the Constitution? What if Edward Snowden violated his oath to secrecy in order to uphold his oath to the Constitution, which includes the Fourth Amendment, and spilled the beans on the government?

What if all this spying by the feds has spawned spying by the locals? What if more than 50 local police departments now have received false cell towers from the FBI, but have sworn not to tell anyone about them? What if these towers trick cellphone signals into exposing the content of cellphone conversations to the police? What if the police have done this without the knowledge of the elected representatives who are their bosses? What if they do this without any warrants? What if the Supreme Court last year outlawed police invading cellphones without warrants?

What if both Bush and Obama have argued that their first job is to keep America safe, and they will twist, torture the plain meaning of and even break laws in order to accomplish that job? What if the presidential oath is to enforce all laws faithfully, including ones the president may hate?

What if Bush and Obama have been wrong about the priority of their constitutional duties as president? What if the president's first job is to preserve the Constitution? What if that includes the Fourth Amendment? What if the president keeps us safe but unfree?

What if invading our freedoms keeps us less safe? What if the president has failed to keep our freedoms safe? What if the government doesn't like freedoms? What if the government is afraid we will exercise them?

For Death by ISIS You Have to Go Out; Illegal Aliens Deliver! Ann Coulter | Feb

You can always tell the media are hiding something when they obsessively focus on Muslim atrocities someplace else in the world. Cable TV could cover Muslim atrocities 24 hours a day, seven days a week, from 632 A.D. to the end of time, without repeating themselves.

For at least a year after 9/11, I used to turn on the TV, and if I saw a "Survivor" contestant, I'd think, "Good. No news." These days, I turn on the TV, and if I see former U.N. ambassador John Bolton, I think, "Good. No news."

By now, the public knows more about ISIS than they know about the Kardashians. But it has no idea that the very same Senate Democrats who claimed to oppose Obama's amnesty when they were campaigning are currently filibustering a bill to defund it, and Senate Majority Leader Mitch McConnell is ready to cave.

ISIS has killed four Americans -- in Syria. We're not exactly talking about another 9/11. Here's a tip: If you don't want to be killed by ISIS, don't go to Syria.

Meanwhile, illegal aliens have killed, raped and maimed thousands of Americans -- in America. If you don't want to be killed, raped or maimed by illegal immigrants in your own country, I have no tips for you. There's nothing you can do. You're on your own. Good luck.

Our politicians don't care. They are obsessed with cleaning up the rest of the world, while we're getting our clock cleaned at home.

Americans are at greater risk of being killed by Joran van der Sloot than by ISIS, since a lot more of us vacation in Aruba, as Natalee Holloway did, than in Syria. So why doesn't Sen. John McCain drone on, day after day, Joran van der Sloot is winning. We're neither degrading nor destroying Joran van der Sloot.

With the media's Soviet-style censorship about immigrant crime, unless a member of your immediate family has been killed by an illegal alien, you might not have noticed the growing death toll, but here are some small, below-the-fold local news items just from the last two weeks.

On Monday of this week, Jaime Balam, an illegal alien from Mexico, appeared in court in San Francisco to face charges that he shot three American college students, one fatally, because they happened to be wearing the wrong colors. "I would never expect something like this to happen in my life," the murder victim's father said. "These guys, they destroyed my life, me and family, for nothing."

Also this week, Juan Javier Mejia was captured in Mexico and returned to the U.S. to face charges that he and his half-brother, Abram Daniel Palacios, gunned down Ivan Carrillo in San Jacinto, California. Mejia has previous convictions in this country for rape and assault with intent to commit rape and burglary, while his half-brother Palacios has prior convictions for narcotics possession, criminal threats and spousal battery.

Also just this week, jury selection began in the trial of illegal alien Dora Ramirez, who, along with her illegal alien husband, Ulises Arturo Reyes Mercado, is alleged to have lured her lover to a rural area of Alabama, where they shot him in the head, execution-style, then fled back to Mexico. Ramirez later returned to live in Decatur, Alabama, with her illegal alien parents, while Mercado is presumably still in Mexico, eagerly awaiting his "family reunification" under Obama.

Last Friday, Feb. 21, Margarita Garabito was convicted in the brutal beating death of her 10-year-old stepdaughter. When the girl was found, she had an open 7-inch wound on her skull, all her ribs had been broken and her body was covered with bruises. Or, as Garabito said -- through a Spanish interpreter -- "God knows I have a good heart." Well, I think that goes without saying, Margarita.

The day before that, on Feb. 20, Bassel Saad, the Lebanese immigrant who killed John Bieniewicz at a soccer game in Livonia, Michigan, last year, pleaded guilty to involuntary manslaughter.

Last Tuesday, Feb. 17, illegal alien Juan Ramon Garcia tried to run over a U.S. Border Patrol agent with his car, according to authorities. Garcia had five more illegal aliens in his vehicle. He's charged with assault on a federal officer, human smuggling and impersonating Suge Knight.

The previous week, on Feb. 11, illegal immigrant Ricardo Picasso was sentenced to 139 years in prison for murdering 25-year-old Eric Reyes at a house party in Lindsay, California. His lawyer is pretty sure he can get that down to just a century.

On Feb. 6, the same day that ISIS killed Kayla Mueller -- the most recent American to be killed in a country thousands of miles away from here -- 17-year-old Jacob Koffman was stabbed to death in a residential area of Sherman Oaks, California. Police arrested Ennio Avolio and are still looking for two other Hispanic men who were seen fleeing the crime scene.

ISIS is not at our doorstep. Illegal immigrants are not only at our doorstep, but millions of them are already through the door, murdering far more Americans than ISIS ever will.

Sometimes people don't want to be cleaning up the rest of the world.

Lenin seized power from Russia's provisional leader, Alexander Kerensky, in 1917, because Kerensky would not stop fighting wars. By promising peace, Lenin won such widespread support from exhausted Russians that the Bolsheviks were able to overthrow the government in less than a day.

That's what a lot of Americans thought they were voting for last November. Couldn't we please focus on Americans for a bit? Can't a Republican Congress do anything to stop the surge of foreign criminals, viruses and parasites crossing our border? Will politicians ever stop gassing on about what's happening 7,000 miles away and worry about us?

But politicians and the media only want to give us war, while aiding the enemy in the war we're already in, here at home.

Jon Stewart and Me Judge Andrew Napolitano | Feb 19, 2015

About six years ago, one of my producers at the Fox News Channel received a call out of the blue in which the caller asked if I'd be interested in coming on "The Colbert Report." At the time, I was generally unfamiliar with the genre of late-night comedy because I am usually in dreamland when it airs.

Colbert was hilarious in his haughty imitation of the excesses of my Fox colleague Bill O'Reilly. I did not and do not know what his personal politics are, but his shtick was playing O'Reilly to a T. In fact, at one point during our back-and-forth, I inadvertently called him "Bill." He stopped the act, came out of character and kissed me. Later he claimed it was one of the most novel and show-stopping uses of a single word he had experienced.

A few months later, my producer received a call from a producer for Colbert's boss, Jon Stewart. That caller asked if I wanted to be on Jon's show to discuss my latest book. That was five books and five appearances ago.

The on-air experience with Jon Stewart is unlike anything I do at Fox. First, when you are Jon's guest, you are his only guest. Second, as the only guest, you are on the show for about 15 minutes. In TV time, and by Fox standards, 15 minutes as an on-air guest is an eternity. Third, Jon spends the first 15 minutes of the show bashing you or your ideas or your employer -- and he did this to me all five times I was on with him. So, by the time I first walked onto his set, the 400 or so folks in his live studio audience were expecting me to have two horns and a tail.

I decided to push the envelope a bit. Before Jon could question me, I told him my purpose in coming on his show was to out him as a closet libertarian. "Go ahead, Your Honor. Give it a try. This is ridiculous." OK, here goes... "Is it any of the government's business whom you marry or what you put into your body or to whom you speak on the phone?" "Of course not." Good. "Should the U.S. be traveling the globe looking for monsters to slay?" "No; never." Excellent. "Can the feds constitutionally capture the content of your phone calls and emails without a search warrant from a judge based on evidence about you?" "No." Terrific.

I should have stopped there, but I was having too much fun with America's funniest comedian. "Are you a secret admirer of Rand Paul?" OK. I blew it. He exploded with his characteristic inanity, and the audience roared with Jon and me, thinking we had rehearsed this.

So began a happy friendship during the course of which we have discussed and analyzed on air nearly every aspect of the proper role of the government in our lives. We were and are admittedly an odd couple. He is the progressive Jewish funnyman with a tongue as sharp as a serpent's tooth, trying to sound smart. I am the libertarian traditionalist Catholic defender of the Constitution, trying to be funny.

Well, a strange thing happened. We agreed more than we disagreed, and I learned what most of his fans do not know: Jon does not need to try to sound smart; he may be the smartest personality on television. He is as well read in the works of those with whom he disagrees as he is in the works of those who reinforce his own views.

During last winter's version of the polar vortex, a bit like the weather this week in the northeast, I left a restaurant in lower Manhattan one night and was waiting for a car to pick me up when I saw a man wearing two overcoats and a hoodie walking a three-legged dog. I couldn't see the man's face, but I recognized the dog, and the dog recognized me. Then I heard the man, who was on his cellphone, spell my last name in a loud booming voice to whomever was on the other end of the call.

It was Jon. His dog jumped up to lick my face. Jon hugged me and said, "Judge, please come on the show next week. Let's talk about something that we will not disagree on." "What?" "Lincoln..." Oy. We disagreed profoundly. Jon had a black actress about a foot and half taller than I am playing Lincoln and three leftie-loony professors who were blind to historical truths trying to rough me up. It was hilarious.

I was saddened when Jon announced his retirement last week. Jon is a comic genius. His ratings are the envy of all in cable TV. He is the principal news source for millions of young people, who are the principal targets of TV advertisers -- and God love him, he is his own boss. He has five dogs who run around that studio, and also a lot of love. Agree with him or not, he is intellectually honest, sharp as a tack, and so warm and engaging that you just don't want your time with him to end.

I hope mine doesn't.

Now that a federal judge has held Obama's illegal executive amnesty unconstitutional, perhaps U.S. senators will remember that they swore to uphold the Constitution, too. 

Back when they needed our votes before the last election, Republicans were hairy-chested warriors, vowing to block Obama's unconstitutional "executive amnesty" -- if only voters gave them a Senate majority. The resulting Republican landslide suggested some opposition to amnesty. 

Heading into the election, college professor Dave Brat took out the sitting House majority leader and amnesty supporter Eric Cantor in a primary, despite being outspent 40-1. It was the greatest upset in history since the 1980 "Miracle on Ice" at the Lake Placid Olympics: Never before has a House majority leader been defeated in a primary. And Brat did it by an astonishing 55.5 percent to 45.5 percent. 

Again, the voters seemed to be expressing disquiet with amnesty. 

After that, even amnesty-supporting Sen. Lamar Alexander, R-Tenn., was denouncing Obama's executive amnesty. "If the president were to do that," he said, "and we have a Republican majority in the United States Senate, why, we have a number of options that we don't now have to remind him to read Article I of the Constitution." 

Poll after poll showed Americans ranking illegal immigration as the No. 1 most important problem facing the nation. We haven't changed our minds. Last week, an Associated Press-Gfk poll showed that Obama's single most unpopular policy is his position on illegal immigration. 

In other words, Obamacare is more popular than amnesty. That's like losing a popularity contest to Ted Bundy. 

Since at least 2006, voters have insistently told pollsters they don't want amnesty. Seemingly bulletproof Republican congressmen have lost their seats over amnesty. President Bush lost the entire House of Representatives over amnesty. What else do we have to do to convince you we don't want amnesty, Republicans? Make it a host on "The View"?

Before the election, then-Senate Minority Leader Mitch McConnell complained that Obama's decision to delay his executive amnesty until after the election was a ploy to prevent Americans from "hold(ing) his party accountable in the November elections." 

But voters went ahead and held Obama accountable! Now McConnell is Senate majority leader -- and he claims his hands are tied. 

McConnell's spokesman at the National Republican Senatorial Committee, Brad Dayspring, predicted that Obama's amnesty threat would drive voters to "elect a new Senate (that) will stand up to the president." 

Check! Mission accomplished! Done and done! Officially off our bucket list. OK, guys, your turn. When do you start standing up to the president? Hello? Hell-oooo? 

To gin up votes, "Republican insiders" told the Washington Examiner last fall that "the results of the midterm elections" would determine how "aggressive" the GOP would be in fighting Obama's amnesty. 

Voters gave you a blow-out victory, Republicans. You cleaned their clocks. (Have you seen Harry Reid lately?) Where's that promised aggression on amnesty? 

Republicans and George Will tell us they can't stand up to Obama's executive amnesty because the media are unfair. 

Oh, well, in that case ... never mind. 

This is news to them? They didn't know the media were unfair when they were promising to block Obama's illegal amnesty before the elections? The media have blamed the GOP for every failure of Republicans and Democrats to reach an agreement since the Hoover administration. This isn't a surprise development. 

Why don't Republicans attack the media? People hate the media! Their power is eroding -- and it would erode a lot faster if Congress would challenge them. Instead of submitting to the media's blackmail, my suggestion is, take their gun away. 

Tell voters what the media won't: that Obama's "amnesty" will give illegal aliens Social Security cards and three years of back-payments through the Earned Income Tax Credit, even though they never paid taxes in the first place. 

Could we get a poll on that: Should the government issue work permits to illegal aliens and give them each $25,000 in U.S. taxpayer money? I promise you, Obama would lose that vote by at least 80-20. Even people vaguely supportive of not hounding illegal aliens out of the country didn't sign up to open the U.S. Treasury to them. 

Tell voters that the media are refusing to report that, for the past two weeks, Senate Democrats have been filibustering a bill that would defund Obama's illegal amnesty. 

Whether or not the Democrats continue to filibuster the bill containing the amnesty defund, the government won't shut down -- contrary to hysterical claims by the media and George Will. The government is funded. Only the Department of Homeland Security (DHS) will be "defunded." 

Which means, wait ... I'm counting on my fingers ... yes, that's right: NOTHING. 

Nearly all DHS employees are "essential" personnel required to stay on the job even if the department is defunded -- the Secret Service, the Transportation Security Administration, the Federal Emergency Management Agency, Customs and Border Protection and the Coast Guard. 

Approximately 200,000 of DHS's 230,000 employees will keep working. 

By "government shutdown," the media mean: "some secretaries will not go to work." 

Why don't Republicans spend all their airtime attacking the media for lying about what Obama's amnesty does and what the Democrats are doing? It's hard to avoid concluding that Republicans aren't trying to make the right arguments. In fact, it kind of looks like they're intentionally throwing the fight on amnesty. 

If a Republican majority in both houses of Congress can't stop Obama from issuing illegal immigrants Social Security cards and years of back welfare payments, there is no reason to vote Republican ever again.

The graphic pictures of a Jordanian pilot being burned alive by militants from the Islamic State, or ISIS, were chilling and raised doubts about the humanity of the Islamic terrorists capable of such barbarism. This coupled with beheadings and crucifixions gives us a better understanding of the evil we, along with the rest of the world, are facing.

These terrorists have stated their intention to annihilate Israel and to destroy the American way of life, which they consider corrupt and evil. Undoubtedly, we in America have our faults like every other country inhabited by human beings, but it requires the suspension of knowledge of accurate American history to believe, as some do, that we are the source of much of the trouble in the world. Conditions in the world have improved more dramatically since the advent of the United States than at any other time in human history. Our innovation and compassion have provided one of the highest standards of living in the world while lifting conditions in many other nations.

Understanding that we are not evil makes it easier to identify evil elsewhere and to combat it effectively. When we accept the falsehood that everyone is equally bad, and, therefore, we have no right or obligation to interfere with atrocities occurring elsewhere in the world, we facilitate the development and growth of groups such as ISIS, which are not dissimilar to the adherents of Adolf Hitler, who also aspired to world domination. An objective analysis of American history will demonstrate that we were late in joining the efforts of others to combat evil during both World War I and World War II. Hopefully, we have learned from these mistakes that it is better to fight enemies while they are in their adolescent stages than to wait until they have fully matured and pose a much greater threat.

I certainly do not believe that we need to involve ourselves in every conflict on the planet, and I believe we involved ourselves in the Vietnam conflict without clear goals or strategies. Hopefully, we learned from that experience that it is neither wise nor correct to try to impose our way of life on others. I also believe that there were better ways to handle Saddam Hussein than a full-fledged military confrontation. Those better ways would have involved a plan for Iraqi leadership over the long term. These unfortunate experiences have made some gun-shy to the point that they probably would rather be invaded than adopt an offensive war posture.

This is a critical time in the history of the world, and we must clear our heads and think logically about the consequences of underestimating the threat posed by a host of Islamic terrorist groups. It is clear that they have a plan that they believe will yield a victory in their quest for world domination. Some in our country are arrogant enough to believe such a goal is preposterous. Others believe our time has come and gone and resistance is useless.

Both of these beliefs are absolutely wrong and do not take into account the strength and resolve inherent in the American character. The battle we are entering will be difficult and fraught with surprises, but as Winston Churchill said, "You ask, what is our aim? I can answer in one word. It is victory. Victory at all costs. Victory in spite of all terrors. Victory, however long and hard the road may be, for without victory, there is no survival."
