Running on Empty

Fresh off of my jaunt down memory lane with The Beach Boys, I decided to revisit another iconic group: Crosby, Stills and Nash. Sadly, the results were much darker than with the Good Vibrations crew.

Back in 1969, CSN played at Woodstock and immediately became a counterculture sensation. Their anti-establishment anthem "Ohio" defined the Vietnam era for many Americans. While The Beach Boys were surfin' the days away, CSN was agitating for societal change using soaring harmonies and relevant lyrics.

Along the way, the guys became millionaires, and David Crosby perpetrated a series of bizarre drug-fueled incidents. He only survived his excess by receiving a liver transplant.

But there he was on stage still sounding pretty good. Graham Nash can also hit most of his notes. Stephen Stills, however, has trouble replicating the voice we know from the old tunes. He also looks like an Amish guy. I thought he was going to sell furniture to the crowd._

At first, the folks loved the liberal old timers. They opened with "Carry On" and played a few more of their classic hits. But then, as so often happens in concert land, the group began playing stuff nobody ever heard of -- and the crowd grew restless.

The low point of the concert arrived when CSN sang a protest song about alleged traitor Army Pvt. Bradley Manning. He is charged with leaking classified information to the anti-American website WikiLeaks. If the charges are true, Manning put many of his fellow soldiers fighting in Afghanistan in even more danger. He is currently being held at Fort Leavenworth, Kan., and, if convicted, could be sentenced to life in prison.

Nevertheless, Crosby, Stills and Nash believe Manning is a political prisoner who has been brutalized by the U.S. military. So they sang a song lamenting that. The folks who paid good money to savor old memories mostly listened in silence. My bet is that many in the crowd had no idea what was going on. It was certainly a far cry from "tin soldiers and Nixon coming."_

There is something to be said for remaining consistent in your values, so I am not down on CSN for their leftist sensibilities. I simply believe that their sympathies are misguided and that protest songs about an obscure man who may have committed treason are useless. Despite their righteous indignation, the truth is that Crosby, Stills and Nash have no idea what Manning did or did not do.

Also, there is irony in the fact that the trio is comprised of 1 percenters who live very well. Crosby bunks in tony Santa Barbara, Stills in Bel-Air right near Nancy Reagan, and Nash on the lush island of Kauai. Nothing wrong with that; those guys earned their affluence. But a system that allows them to profit from protest might be one to applaud. Hey, guys, how about a song on that theme?

In the end, I was disappointed by the CSN concert. At one time, their voices soared both musically and socially. Now, they are just shadows of a time long gone.

Decision Time

WASHINGTON -- It's been a week of big decisions in our nation's capital. The Supreme Court's 5-4 verdict on Obamacare was the biggest story for politicians, pundits and the so-called mainstream media. That the justices reaffirmed the constitutional authority of Congress to levy taxes -- even when the tax is called a "mandate" -- should not have surprised anyone. The second-place decision of the week was the unprecedented 255-67 vote in the U.S. House of Representatives to hold Attorney General Eric Holder in contempt of Congress for his unwillingness to respond to congressional subpoenas for information on the Obama administration's notorious "Fast and Furious" gunrunning scheme.

Both of those decisions will provide countless hours of debate, commentary and fuel for political fundraising over the next four months. Though neither matter will be completely resolved until after Americans go to the polls Nov. 6, at least the Supreme Court and the House of Representatives have proved that they can make decisions -- and we know how they were made. Though the Supremes always debate in private, their determination is explained in depth -- and by reading their decision, we know the thinking of each member of the court. The House debate and vote on holding Holder in contempt was conducted in the open for all to see.

The American people now can weigh where they stand on those decisions and decide for themselves whether they agree and, in the case of Congress, whether they want to return or replace their representatives. But we still don't know how decisions are made at 1600 Pennsylvania Ave. -- and it has been that way since the O-Team arrived in Washington, particularly on matters of national security.

This is, after all, the administration that came to office promising "transparency," a "responsible end to Bush's wars," to "shut down Gitmo" and to "try terrorists in civilian courts." Now, better than three years on, none of that has happened -- other than the precipitous withdrawal of U.S. and NATO troops from Iraq.

Other than with a tidal wave of leaks -- all designed to portray a dithering administration in disarray as bold and decisive -- the White House never has explained the "what, why and how" for the decisions it has made (or has failed to make) on issues affecting our security. Worse, the damage done by publicly disclosing highly classified national security information has put Americans at risk, jeopardized our ability to collect important intelligence and seriously damaged vital relationships with our allies. The Obama White House now says the leakers "must be held accountable." That's about as likely as the sun rising in the west tomorrow morning.

This week's domestic policy decisions on Capitol Hill obscure the sanguinary consequences of attention-deficit disorder at the White House. In his June 4, 2009, Cairo speech, Obama famously expressed his "commitment" to "governments that reflect the will of the people" and specified, "You must maintain your power through consent, not coercion; you must respect the rights of minorities and participate with a spirit of tolerance and compromise; you must place the interests of your people and the legitimate workings of the political process above your party."

Yet just two weeks later, when the ayatollahs ruling in Iran brutally crushed a popular challenge to a fraudulent presidential election, the O-Team decided to do nothing. Four months later, he was named a Nobel Prize winner.

Last year, as Arab Spring revolutions began sweeping dictators from power in Tunisia, Egypt and Libya, the White House announced a new doctrine: the "responsibility to protect" innocent civilians from despots -- and let the United Nations and NATO "take the lead."

Now, for the Syrian people caught in the crossfire of a civil war, the lack of American leadership is nothing short of catastrophic. Human rights groups estimate that the 15-month rebellion against the Assad regime in Damascus has cost more than 14,000 lives and at least 25,000 wounded -- most of them innocent civilians.

On June 28, as the White House focused on Supreme Court and congressional decisions in Washington, Turkish troops were moving into position along their border with Syria. In Ankara, Prime Minister Recep Tayyip Erdogan said that his army regards Syrian military units approaching Turkey as a threat.

At the same time, Russian President Vladimir Putin has dispatched more naval infantry to protect the Russian naval base at Tartus -- and presumably the underground joint Syrian-Russian command center in Damascus. The Obama administration, distracted by events in Washington, issued a response from Secretary of State Hillary Clinton in Helsinki, Finland: "We have great hope" that a meeting this weekend in Geneva hosted by U.N. special emissary Kofi Annan will be "a critical turning point."

The operative word is "hope." Hope is not a course of action. A course of action necessitates making decisions. Decisions require paying attention to what's happening. That's just one more reason we need to hire a commander in chief with an attention span greater than that of a fruit fly.

Obamacare Ruling a Dark Day for America -- but With a Major Upside

The Supreme Court's ruling in Obamacare v. the United States of America is yet another body blow to the U.S. Constitution's principle of limited government and the freedom tradition, but there is a major upside.

Despite President Obama's opposition to an individual mandate when he was debating Hillary Clinton during the Democratic presidential primaries and despite his postelection insistence that Obamacare's mandate does not constitute a tax, his lawyers insisted otherwise, and the Supreme Court bought it. So we have a law with enormous reach -- one-seventh to one-sixth of the economy -- having been fundamentally misrepresented to the American people from the beginning.

Conservatives who believe that the Constitution should be interpreted according to the plain meaning of its language and the original intent of the Framers have long been troubled by the court's decisions expanding the commerce clause to authorize Congress to regulate the most local of matters within a state's borders.

Many legal analysts were predicting the court would declare the mandate unconstitutional because it goes further than all other previous cases in forcing Americans to purchase a commodity. Surely, they reasoned, the court would not go that far.

Well, as it turns out, the court didn't have to. It simply chose to consider the mandate a tax rather than a fine or penalty and held that the court has ample authority under the general welfare clause to impose a tax. Voila, problem solved.

There is little to be gained at this point in crying over spilled judicial milk. That chapter, on this essential issue, is closed for now. But the substantive issues -- the questions of the wisdom of the law itself and the people's opinion about it -- are very much alive, especially considering that we have our national elections in November.

It is not an overstatement to say that Obamacare was the single most important catalyst leading to the tea party movement. Americans were outraged and horrified by this president's reckless spending and his endless assaults on the Constitution, but no issue drove them to rise up and fight back like Obamacare -- both the abominable legislative monstrosity itself and the tyrannical, corrupt manner by which Obama crammed it through the legislative process.

Americans oppose Obamacare because they understand that it is inconsistent with our liberties and our idea of limited government and that it will destroy the best health care system in the world.

Almost everything about Obamacare has been a lie. Let's just start with the gloating Democrats' assertion that the court has validated their effort to make quality health care affordable for every American.

Contrary to Obama's misrepresentations, Obamacare will bend the cost curve up, not down, and will do so significantly; the Congressional Budget Office has already told us that it will cost almost double what Obama promised. The law's other main ostensible purpose -- to increase access -- is another sham.

There is a world of difference between increasing the number of people who have insurance coverage and increasing their actual access to quality medical care, and it's care that we should be concerned about, not insurance. The only way health care costs under a socialized system can be contained at all is by rationing. This is the history of every other socialized health care system in the world. It is the history of Medicare. It is why Obamacare creates an egregious 15-member bureaucratic board -- the Independent Payment Advisory Board -- that will make decisions as to the costs of treatments. As a necessary consequence, the patients' choices of and access to various treatments will both be severely diminished under Obamacare.

The quality of health care will also diminish. Doctors are already planning to leave the medical profession in droves. They are advising their family and friends not to choose the profession. People are not being allowed to keep their plans as Obama cynically promised. The Willis survey reports that only 30 percent of employers will keep their same plans under Obamacare.

The anxiety brought on by Obamacare -- including that brought on by the tsunami of additional federal rules, regulations and taxes it will impose on small businesses -- is having a crippling effect on job creation in this country. Seventy-four percent of small businesses say they are not expanding because of Obamacare.

The American people overwhelmingly oppose this federal power grab, which is why Mitt Romney and the Republican Party had better read their cue cards and understand that now is not the time for fecklessness. It is the time to draw clear contrasts between the Republican vision and the Obama record.

I believe that this ruling by the court will reinvigorate the tea party movement in a way that nothing else could have and, provided Republicans don't blow it by refusing to take the gloves off in the campaign, could help lead to a GOP landslide in November.

COLORADO SPRINGS, Colo. -- Did you know that President Obama has been incommunicado with Colorado's governor for more than two weeks as the nation's worst wildfires rage across the state? Maybe he thought we were all "doing fine." After an embarrassing Beltway press briefing revelation about our out-of-touch White House, the administration finally decided to divert the campaigner in chief from his nationwide fundraising frenzy for a quick look-see at our devastated city on Friday. It's "leadership from behind" you can count on.

On Wednesday, press secretary Jay Carney acknowledged that Obama hadn't talked to Democratic Gov. John Hickenlooper in 15 days. Holy smokes. The High Park fire, which has consumed nearly 90,000 acres and claimed nearly 257 homes west of Fort Collins, ignited on June 9 and is still active. During a campaign swing just last week, first lady Michelle Obama made a brief mention of the High Park fire before launching into her standard GOP-bashing stump speeches.

On June 23, the Waldo Canyon fire in Colorado Springs erupted. An estimated 19,000 acres and nearly 350 homes burned down to the ground on Tuesday. More than 32,000 have been displaced so far. My family was forced to abandon our home on Saturday, and our neighborhood remains in a mandatory evacuation zone. On June 27, Boulder's Flagstaff fire broke out and has so far blazed through 300 acres.

While he made no public statements prior to the announcement of his visit, an irritated Carney told reporters on Wednesday that Obama was being "updated regularly" on the wildfires in Colorado and across the West. He then rushed out a face-saving press release heralding the president's hasty phone call that afternoon to Hickenlooper and Colorado Springs Mayor Steve Bach, in which he "expressed his concern about the extent of damage to homes in the Colorado Springs area, and informed both the governor and the mayor that he plans to travel to the area Friday to view the damage and thank the responders bravely battling the fire."

As Obama sightsees overhead in this key swing state and surrounds himself with first responders for campaign-ready photo-ops, his supporters on the ground are busy spewing excuses, attacks and death wishes on their political opponents. I know. I've received countless numbers of them hoping that firefighters let my "mansion" burn down and gloating that God is punishing Colorado's conservative population. Liberals took to Twitter to bash local GOP officials as "fire retardants" who should be dropped over the blaze. And jokes about Colorado social conservatives like this proliferated: "If this Colorado fire takes out the Focus on the Family campus, then God really exists."

The sniping isn't limited to social media. Obama strategist Rahm Emanuel said in 2008: "You never want a serious crisis to go to waste." On cue, Hickenlooper mocked limited-government watchdogs who questioned the Obama administration's decision to cancel a key aerial tanker contract last summer. (It was the topic of my June 20 column last week, "How Obama Bureaucrats Fueled Western Wildfires.") The Denver Post reported Wednesday:

"Asked about criticism from the right over the Obama administration's canceling of the contract, Hickenlooper offered an uncharacteristically strong defense of the president. 'Were these the same conservatives that were so worried about the Obama administration spending too much money, or were these different conservatives?' Hickenlooper said. 'Quite honestly, in a situation like this where over 30,000 people have been evacuated, I don't think that (criticism of Obama) is appropriate,' the governor said. 'We should be focusing our support on them and on the people out there risking their lives to fight these fires.'"

Spare us the sanctimony, and lay off the firefighter human shield strategy. The conservatives in Congress and libertarians at MonkeyWrenchingAmerica.com and elsewhere on the right who called attention to the U.S. Forest Service's aging, neglected and undercapitalized aerial tanker fleet are the same conservatives who have doggedly called attention to the Obama administration's serial squandering of taxpayer dollars on nonessential, ineffective, crony-driven spending. We are the conservatives worried about dumping billions of dollars into bankrupt federal green boondoggles like Solyndra, Abound Solar, Beacon Power, Ener1 and LightSquared at the expense of fundamental services -- like fighting fires.

It is entirely appropriate and possible to question this administration's policy decisions while supporting frontline emergency personnel at the same time. And it is entirely logical and rational to express gratitude for firefighters and police officers -- while working to ensure the long-term financial viability of their departments through tough but necessary budget and public employee union reforms.

But don't look to Obama to put out the flames of politically expedient and inflammatory rhetoric. He may be slow on the uptake to respond to national crises, but when it comes to exploiting them, he's an industrial-grade accelerant.

A Political Glossary Part IV

Nowhere is political rhetoric more shameless -- or more dangerous -- than in the pious names that politicians give to the legislation they pass. Perhaps the most egregious example is the so-called "Indian Child Welfare Act," which callously sacrifices the welfare of Indian children.

Time and again, children with some American Indian ancestry, who have been adopted by families that are not of that ancestry, have been suddenly taken by law from the only parents they have ever known and transferred to some distant Indian reservation, to live among strangers in a world they know nothing about.

You might think that the sight of bewildered, desperate and weeping children in court, crying out for mommy and daddy as they are forcibly removed from people who have cared for them for years, might cause those who are seizing them to relent. But no! Such children are routinely sacrificed on the altar to the Indian Child Welfare Act.

The child might be two years old or twelve. But the legal rights of a biological relative and tribal authorities trump the well being of the child, even if that biological relative has been a complete stranger to the child.

Some years ago, the chairman of the Civil Rights Commission visited a 14-year-old girl who had been removed from her adopted parents and was living on an Indian reservation, where she was miserable. But when the story came out, outrage was directed not at those who had ruined this girl's life, but at the member of the Civil Rights Commission who had dared to intrude on the sacred soil of the Indian reservation.

Similar things have happened to black children raised by white foster parents. There is no Congressional legislation in these cases, but the dogmatism of social workers and so-called social welfare departments can lead to the same results. However, the absence of federal legislation enables those judges who have common sense, and common decency, to prevent similar tragedies in these cases.

What is behind such perverse racial policies? Theories, ideologies and presumptions of superior wisdom and virtue. It has been known for centuries that there are people, especially among the intelligentsia, who love humanity in the abstract but are not all that concerned about what happens to the actual flesh-and-blood human beings who are subjected to their grand visions and policies.

If the vogue of the times is that children should be raised in their own racial culture, that overrules other considerations. As T.S. Eliot said, long ago: "Half of the harm that is done in this world is due to people who want to feel important. They don't mean to do harm -- but the harm does not interest them. Or they do not see it, or they justify it because they are absorbed in the endless struggle to think well of themselves."

But the rest of us need to be on guard against their rhetoric. Nor is the Indian Child Welfare Act the only legislation whose effects are the direct opposite of its title.

The Obama administration introduced legislation called the "Employee Free Choice Act." What would it do? Destroy the free choice of workers as to whether or not they want to be represented by a labor union.

The National Labor Relations Act of 1935 gave workers the right to a federally conducted secret ballot election, in which they could vote to have a union or not have a union. But, as more and more workers in recent years have voted not to have a union, union bosses have pushed for a law to allow this decision to be made without a secret ballot. This would allow union organizers to use pressure and coercion on those who don't want to have a union.

Since union bosses contributed both money and manpower to the election of Barack Obama, it is hardly surprising that he was willing to reciprocate with the "Employee Free Choice Act."

In this case, the Act failed to pass in Congress. But President Obama accomplished some of its goals by appointing pro-union members to the National Labor Relations Board, whose regulations tilted elections in the unions' favor.

If you can't be bothered to look beyond rhetoric to realities, don't complain about bad laws, or even about the degeneration of law itself into arbitrary rule over what was once a free people.

Tradition says that on this day in 1778, the day after the Battle of Monmouth in New Jersey, Mary Ludwig Hays of Pennsylvania—known to her friends as Molly—stood before General Washington and received a warrant as a noncommissioned officer in return for bravery in the battle.

Like many colonial wives, Molly had joined her husband, John, when he marched off to fight the British during the Revolutionary War. She spent her time in the camps, cooking, washing, and taking care of supplies.

June 28, 1778, found John Hays manning a cannon at Monmouth on an afternoon when the temperature soared close to one hundred degrees. Gasping soldiers began to drop from thirst and exhaustion, so Molly grabbed an artillery bucket and carried water from a cool spring to the troops. According to legend, the grateful men cheered "Molly with her pitcher," and afterward she was known as Molly Pitcher.

Molly also nursed the wounded that day. At one point she hoisted an injured soldier to her shoulders and lugged him clear of a British charge. When her husband fell wounded beside his cannon, she seized the rammer staff and worked the rest of the day swabbing and loading the gun under heavy fire. An eyewitness to the battle described how "a cannon shot from the enemy passed directly between her legs without doing any other damage than carrying away all the lower part of her petticoat."

The next day, it is said, George Washington thanked the barefooted, powder-stained Molly. In 1822 the Pennsylvania legislature voted to pay her $40 a year in recognition of her service. Since then, the name Molly Pitcher has come to stand for all the brave women who came to their country's aid during the war for independence.

Rubio's Time Will Come

"Rubio, Rubio, Rubio."

You hear the chants all across the country. On talk shows, on cable TV, on blogs and in op-ed columns, everyone with a conservative bone in his body is urging presumptive GOP nominee Mitt Romney to choose the smart and dashing Marco Rubio as his vice president.

The conservative crowd's clamor for Rubio is beginning to worry me. It could backfire. For one thing, it's setting up Romney for a disaster.

If he doesn't choose Rubio -- and I would agree with that decision -- it's going to disappoint a lot of Republican voters who think Rubio is the key to de-electing President Obama. And when voters are disappointed, they don't show up to vote.

Don't get me wrong. Rubio is great, maybe the best young talent in the Republican draft pool. The first-term Florida senator is already a superstar and ready for the big leagues -- and that's the biggest problem I have with picking him.

When you're trying to get elected president, you don't pick a superstar for your running mate. You pick someone boring, someone who is not going to eclipse you the way Sarah Palin outshined John McCain just four years ago.

I admit it wasn't hard to outshine McCain. But if he hadn't been so desperate to put some life into his lackluster campaign, he would have done the wiser thing and chosen someone even more boring than himself.

It was Reagan and Bush I. Bush I and Quayle. Clinton and Gore. Gore and ????? Whoever it was, he or she was so boring I can't remember their name. Was it Kerry? Biden?

Just joking, but you get the point. In 2000, the Bush II-Cheney ticket turned out to be a mini-mistake. Dick Cheney was so experienced and such a strong personality that he acted like a co-president for eight years, which only caused trouble for George W. Bush.

There's only room for one star on the ticket. Romney doesn't need Rubio or Chris Christie or Condi Rice, or even Paul Ryan. He needs a Tim Pawlenty, a Rob Portman or a Bob McDonnell -- a non-star.

He needs someone who's a virtual unknown to the voting masses, but nonetheless experienced in governing and ready to do the VP's thankless jobs of attending funerals and waiting for the chance to break a tie vote in the Senate.

Nobody ever votes for a president because they like the VP. Romney has to be the only star. Period. He has to be the focus of the Republican ticket.

Unlike McCain, who had to appear with Palin most of the time just to draw a crowd, Romney needs to have a VP who can campaign for him elsewhere without attracting all the media attention or showing him up.

That might be hard. Mitt is not exactly known for his star power. But he doesn't need to be exciting to win the White House. He needs to show voters that he has the ideas and the governing skills to pull the economy out of the deep ditch Mr. Obama's got us stuck in.

Rubio will have his day. So will future Republican all-stars like Christie, Ryan and Bobby Jindal. The GOP has a deep bench.

But Mitt's the GOP's QB now. He's got to ignore the crowd of conservatives who want him to throw the long bomb to Rubio. He's got to call his own play for VP -- and make it good but boring.

Restraining Arizona, Unleashing the President
 

The legislation created two conflicts that rose to the national stage. The first is whether any government may morally and legally interfere with freedom of association based on the birthplace of the person with whom one chooses to associate. The second is whether the states can enforce federal law in a manner different from that of the feds.

Regrettably, in addressing all of this earlier in the week, the Supreme Court overlooked the natural and fundamental freedom to associate. It is a natural right because it stems from the better nature of our humanity, and it is a fundamental right because it is protected from governmental interference by the Constitution itself. Freedom of association means that without force or fraud you may freely choose to be in the presence of whomever you please, and the government cannot force you to associate with someone with whom you have chosen not to associate, and the government cannot bar anyone with whom you wish to associate from associating with you.

Without even addressing the now-taken-for-granted federal curtailment of the right to associate with someone born in a foreign country and whose presence is inconsistent with arbitrary federal document requirements and quotas, the Supreme Court earlier this week struck down three of the four challenged parts of the Arizona statute, which attempted to supplant the federal regulation of freedom of association with its own version. It did so because the Constitution specifically gives to Congress the authority to regulate immigration, and Congress, by excluding all other law-writing bodies in the U.S. from enacting laws on immigration, has pre-empted the field.

The court specifically invalidated the heart and soul of this misguided Arizona law by ruling definitively that in the area of immigration, the states cannot stand in the shoes of the feds just because they disapprove of the manner in which the feds are or are not enforcing federal law. The remedy for one's disapproval of the manner of federal law enforcement is to elect a different president or Congress; it is not to tinker with the Constitution.

Federal law cannot have a different meaning in different states, the court held. And just as the feds must respect state sovereignty in matters retained by the states under the Constitution (though they rarely do), so, too, the states must respect federal sovereignty in matters that the Constitution has unambiguously delegated to the feds.

The court neither upheld nor invalidated Section 2B of the Arizona statute -- which permits a police inquiry of the immigration status of those arrested for non-immigration offenses -- because the court found that, just as when the police stop a person for a violation of state or local law they may check their computers for outstanding warrants for the person they have stopped, so, too, they may check their computers for the person's immigration status.

Shortly after the opinion came down, the Obama administration announced that it will cease providing Arizona police with the immigration status of persons in that state, and it will not detain anyone arrested by Arizona police for immigration violations unless those violations rise to the level of a felony, which undocumented presence in the U.S. is not. Thus, this constitutional rebuke to Arizona has become a personal license for the president. He now has demonstrated that he will not faithfully enforce federal law as the Constitution requires. He will only enforce the laws he agrees with.

So, since the Arizona police cannot arrest and incarcerate anyone for undocumented presence and since they cannot deliver anyone so arrested to the feds, what legitimate governmental purpose will be served by what remains of Arizona's law? None. But the police still will harass any dark-skinned person in Arizona that they please.

Have we lost sight of the perpetual tension between human freedom and human law? Either freedom is integral to our nature, as Thomas Jefferson wrote in the Declaration of Independence, or it comes from the government, as the president and the Supreme Court demonstrated they believe this week. If it is integral to our nature, no government can tell us with whom we may freely associate. If it comes from the government, we should abandon all hope, as the government will permit the exercise of only those freedoms that are not an obstacle to the contemporary exercise of its powers.

A Political Glossary: Part III

If there were a Hall of Fame for political rhetoric, the phrase "social justice" would deserve a prominent place there. It has the prime virtue of political catchwords: It means many different things to many different people.

In other words, if you are a politician, you can get lots of people, with different concrete ideas, to agree with you when you come out boldly for the vague generality of "social justice."

Justice Oliver Wendell Holmes said that a good catchword can stop thought for 50 years. The phrase "social justice" has stopped many people from thinking, for at least a century -- and counting.

If someone told you that Country A had more "social justice" than Country B, and you had all the statistics in the world available to you, how would you go about determining whether Country A or Country B had more "social justice"? In short, what does the phrase mean in practice -- if it has any concrete meaning?

In political and ideological discussions, the issue is usually whether there is some social injustice. Even if we can agree that there is some injustice, what makes it social?

Surely most of us are repelled by the thought that some people are born into dire poverty, while others are born into extravagant luxury -- each through no fault of their own and no virtue of their own. If this is an injustice, does that make it social?

The baby born into dire poverty might belong to a family in Bangladesh, and the one born to extravagant luxury might belong to a family in America. Whose fault is this disparity or injustice? Is there some specific society that caused this? Or is it just one of those things in the world that we wish was very different?

If it is an injustice, it is unjust from some cosmic perspective, an unjust fate, rather than necessarily an unjust policy, institution or society.

Making a distinction between cosmic justice and social justice is more than just a semantic fine point. Once we recognize that there are innumerable causes of innumerable disparities, we can no longer blithely assume that either the cause or the cure can be found in the government of a particular society.

Anyone who studies geography in any depth can see that different peoples and nations never had the same exposure to the progress of the rest of the human race. People living in isolated mountain valleys have for centuries lagged behind the progress of people living in busy ports, where both new products and new ideas constantly arrive from around the world.

If you study history in addition to geography, you are almost forced to acknowledge that there was never any realistic chance for all peoples to have the same achievements -- even if they were all born with the same potential and even if there were no social injustices.

Once I asked a class of black college students what they thought would happen if a black baby were born, in the middle of a ghetto, and entered the world with brain cells the same as those with which Albert Einstein was born.

There were many different opinions -- but no one in that room thought that such a baby, in such a place, would grow up to become another Einstein. Some blamed discrimination but others saw the social setting as too much to overcome.

If discrimination is the main reason that such a baby has little or no chance for great intellectual achievements, then that is something caused by society -- a social injustice. But if the main reason is that the surrounding cultural environment provides little incentive to develop great intellectual potential, and many distractions from that goal, that is a cosmic injustice.

Many years ago, a study of black adults with high IQs found that they described their childhoods as "extremely unhappy" more often than other black adults did. There is little that politicians can do about that -- except stop pretending that all problems in black communities originate in other communities.

Similar principles apply around the world. Every group trails the long shadow of its cultural heritage -- and no politician or society can change the past. But they can stop leading people into the blind alley of resentments of other people. A better future often requires internal changes that pay off better than mysticism about one's own group or about "social justice."

The Biggest Scandal In U.S. History

Forget executive privilege, contempt of Congress, "fast and furious," how many documents the government has produced and who said what to whom on which date.

The Obama administration has almost certainly engaged in the most shockingly vile corruption scandal in the history of the country, not counting the results of Season Eight on "American Idol."

Administration officials intentionally put guns into the hands of Mexican drug cartels, so that when the guns taken from Mexican crime scenes turned out to be American guns, Democrats would have a reason to crack down on gun sellers in the United States.

Democrats will never stop trying to take our guns away. They see something more lethal than a salad shooter and wet themselves.

But since their party was thrown out of Congress for the first time in nearly half a century as a result of passing the 1994 "assault weapons ban," even liberals know they're going to need a really good argument to pass any limitation on guns ever again.

So it's curious that Democrats all started telling the same lie about guns as soon as Obama became president. In March 2009, Secretary of State Hillary Clinton announced to reporters on a trip to Mexico: "Since we know that the vast majority, 90 percent of that weaponry (used by Mexican drug cartels), comes from our country, we are going to try to stop it from getting there in the first place."

As she sentimentally elaborated on Fox News' Greta Van Susteren show: "The guns sold in the United States, which are illegal in Mexico, get smuggled and shipped across our border and arm these terrible drug-dealing criminals so that they can outgun these poor police officers along the border and elsewhere in Mexico."

Suddenly that 90 percent statistic was everywhere. It was like the statistic on women beaten by their husbands on Super Bowl Sunday.

CBS' Bob Schieffer asked Obama on "Face the Nation": "It's my understanding that 90 percent of the guns that they're getting down in Mexico are coming from the United States. We don't seem to be doing a very good job of cutting off the gun flow. Do you need any kind of legislative help on that front? Have you, for example, thought about asking Congress to reinstate the ban on assault weapons?"

At a Senate hearing, Sen. Dianne Feinstein, D-Calif., said: "It is unacceptable to have 90 percent of the guns that are picked up in Mexico and used to shoot judges, police officers and mayors ... come from the United States."

And then, thanks to Fox News -- the first network to report it -- we found out the 90 percent figure was complete bunkum. It was a fabrication told by William Hoover, of the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATF), and then spread like wildfire by Democrats and the media.

Mexican law enforcement authorities send only a fraction of the guns they recover from criminals back to the U.S. for tracing. Which guns do they send? The guns that have U.S. serial numbers on them. It would be like asking a library to produce all their Mark Twain books and then concluding that 90 percent of the books in that library are by Mark Twain.

You begin to see why the left hates Fox News so much.

Obama backed away from the preposterous 90 percent claim. His National Security Council spokesman explained to Fox News that by "recovered," they meant "guns traceable to the United States." So, in other words, Democrats were frantically citing the amazing fact that almost all the guns traceable to the U.S. were ... traceable to the U.S.

Attorney General Eric Holder told reporters that even if the percentage is inaccurate, the "vast majority" of guns seized in crimes in Mexico come from the United States. And he should know, because it turns out he was sending them there!

Apart from the guns Holder was giving them, this was an absurd claim. Most of the guns used by drug cartels are automatic weapons -- not to mention shoulder-fired rockets -- that can't be sold to most Americans. They are acquired from places like Russia, China and Guatemala.

Right about the time the 90 percent lie was unraveling, the Obama administration decided to directly hand thousands of American guns over to Mexican criminals. Apart from the fact that tracking thousands of guns into Mexico is not feasible or rational, the dumped guns didn't have GPS tracing devices on them, anyway. There is no conceivable law enforcement objective to such a program.

This is what we know:

(1) Liberals thought it would be a great argument for gun control if American guns were ending up in the hands of Mexican criminals;

(2) They wanted that to be true so badly, Democrats lied about it;

(3) After they were busted on their lie, the Obama administration began dumping thousands of guns in the hands of Mexican criminals.

We also know that hundreds of people were murdered with these U.S.-government-supplied guns, including at least one American, U.S. Border Patrol agent Brian Terry.

But let's look on the bright side. The BATF was originally going to ship warheads to Iran until realizing the explosions might disable the tracking devices.

(Contrary to more Democrat lies, there was no such program to dump thousands of guns in Mexico under George W. Bush. The Bush administration did have a program that put GPS trackers on about 100 guns in order to actually trace them. That operation was ended almost as soon as it began because of the lack of cooperation from Mexican officials. You may as well say Holder's program was "started" by the first cop who ever put tracer dye on contraband.)

No one has explained what putting 2,500 untraceable guns in the hands of Mexican drug dealers was supposed to accomplish.

But you know what that might have accomplished? It would make the Democrats' lie retroactively true -- allowing them to push for the same gun restrictions they were planning when they first concocted it. A majority of guns recovered from Mexican criminals would, at last, be American guns, because Eric Holder had put them there.

Unfortunately for the Democrats, some brave whistleblower inside the government leaked details of this monstrous scheme. As soon as Congress and the public demanded answers, Holder clammed up. He just says "oops" -- and accuses Republicans of racism.
